    The allegedly “missing” Lois Lerner emails have been found, apparently on a government wide backup system that is taken in the event of a systematic disaster, according to a Monday story in the Washington Examiner. The Justice Department informed the watchdog group, Judicial Watch, of this development. The twist is that now the Obama administration is claiming that the emails will just be too hard to retrieve due to the massive size of the backup system. Rep, Darrell Issa, Chairman of the House Government Oversight Committee that is looking into the IRS targeting of conservative groups, is not amused.

    Issa will now recall the IRS commissioner, who had told his committee that the emails were permanently lost, and ask him some rather hard questions in a private deposition. Issa suggests that he either lied while under oath, a federal crime, or else “choose not to know” certainly relevant facts. Either way, the matter suggests that there is a cover up going on at the IRS concerning how high up the conservative group targeting has gone.

    Now that the existence of the email backups has been admitted to, it is virtually certain that they will be retrieved, no matter how difficult in may be, and then examined in great detail. The suspicion is that they contain some rather damning information. Otherwise, why go to such trouble to deny their existence?
    This should be interesting to see what that partisan dem has to say to Issa now.

    When is someone going to go to jail?

    The IRS may be able to keep Issa at bay, but there are 2 court cases involving FoI requests, and I doubt the IRS will be able to defy a federal judge or judges very long before someone does actually land in jail.

    The DOJ will not go after the missing emails because Lois Lerner is covering not just for the IRS.... she is covering for the DOJ as well. The DOJ (Eric Holder) was getting information (illegally) from the IRS on targeted individuals through Lois Lerner with the hope of at least intimidating and harassing, if not prosecuting, entities on Obama's political hate list. The DOJ must protect Lois Lerner to protect themselves. As long as she keeps her mouth shut, she has Holder's assurance that she will not be prosecuted for so much as jay-walking, she will keep her government retirement, etc.

    I think the most logical conclusion to draw at this point is this has been a delaying action to get this issue past the midterm elections.

    The federal judges are not going to accept whatever excuse the DoJ has, but they have to follow procedure. No matter what they actually believe, the moving party has to lay a predicate to demonstrate that DoJ and IRS have not acted in good faith. At that point, the judges can take drastic measures like sending federal marshalls to seize the evidence and hold the offending AUSAs in contempt, jailing them.

    Everything that's been happening is to get past the first Tuesday in November.

    The IRS has acknowledged those procedures were in place since it told lawmakers in June that Lerner’s computer crashed in 2011, leaving the agency unable to recover many of her emails over a two-year span.

    John Koskinen, the IRS commissioner, has testified before Congress several times over the last two months that the tapes backing up Lerner’s emails were recycled.

    “There is no newly divulged back-up system that was not previously known about,” the official said. “Government lawyers were simply referring to the back-up system at the IRS that Commissioner Koskinen had already disclosed.”

    It is amusing. Somebody posts an article from a right wing site alleging hard to believe outrageous behavior, and all the true believers jump in alleging even worse interpretations of the allegations. Of course this has been par for the course for the entire history of Issa's dry well committee - mountains of charges and no proof. My practice, upon seeing hard to believe charges from tainted sources is to seek accounts of the same event from more even and reputable sources, like in this case, The Hill. Not surprisingly they had the novel idea of providing perspective by adding the other side of the event.

    The flaw in that theory though is the "other side" has been caught repeatedly lying about nearly everything that has occurred during this administration.

    At this point, why would you believe anything at all that the "other side" had to say?

    There is too much incentive for various parties involved in this to lie their rear end off. That stmt is nothing more than to create a he said they said situation.

    We know for a fact b/c the IRS admitted it that conservative groups were targeted. It is now a matter of those parties doing whatever they can to delay and/or bury all pertinent info pertaining to that targeting.

    The smoking gun may have been located.

    Lerner's Blackberry was destroyed in June of 2012. She was questioned by Congress prior to that.

    No matter how you slice it, that's the willful destruction of evidence. In every state and in federal court, that's a felony.

    Not according to the administration source quoted by The Hill - nothing has changed. According to him and as stated at least two months ago, all emails are backed up on tape, but they were recycled every 6 months up until 2013.

    Here's a novel idea - why don't wait and see what happens?
